These terms are an agreement between you and Michael Barbu ("we", "us") about your use of The Ancient Spire (the "Game"). By playing the Game you agree to them. If you do not agree, do not play.

Who can play

You must be at least 13 years old. If you are under 18 (or the age of majority where you live), you must have a parent's or guardian's permission, and they agree to these terms for you, including any purchases.

Your account

You are responsible for your account and for keeping your sign-in safe. Usernames and player icons must not be offensive, impersonate anyone or infringe anyone's rights. We may change or remove a username or icon that breaks these rules.

Your licence to play

We give you a personal, non-exclusive, non-transferable, revocable licence to play the Game for your own non-commercial use. You may not copy, modify, reverse engineer or resell the Game, use cheats, bots or exploits, or interfere with other players or our servers.

Gears, boosters and other virtual items

The Game includes virtual items such as Gears, boosters, cosmetics and season passes. You get a licence to use them in the Game; you do not own them, and they have no cash value. They cannot be exchanged for real money or transferred outside the Game. We may change how virtual items work. Season passes last for the season named at purchase.

Purchases

Purchases are made through the Apple App Store or Google Play and are subject to their terms. All purchases are final except where the law or the store's refund policy says otherwise; refund requests go to Apple or Google. Prices may change. If a purchase does not arrive, contact support@theancient.games and use "Restore purchases" in the Game.

Ads

The Game shows ads, including optional ads you can watch for rewards. Rewards are given only when an ad is completed and confirmed by the ad provider.

Friends, invites and Spire Races

Invite and referral rewards are limited as described in the Game and may not be gained using fake accounts or devices. We may cancel race results or rewards obtained by cheating.

Ending your access

You may stop playing and delete your account at any time (see how to delete your data). We may suspend or end your access if you break these terms. If the Game shuts down we will give reasonable notice where we can; virtual items end when the Game ends.

Disclaimers

The Game is provided "as is" and "as available". We do not promise it will be uninterrupted or error-free, or that any feature or content will always be available.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental or consequential damages, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you.

Governing law

These terms are governed by the laws of the State of Louisiana, USA, except where the law where you live says otherwise.

Changes

We may update these terms. If we make important changes we will tell you in the Game. Continuing to play means you accept the updated terms.
